Peach State Developments LLC - Independent Living Residences

1. Introduction and Scope

Peach State Developments LLC ("The Provider" or "Management") is committed to protecting the privacy, dignity, and autonomy of all residents. This policy outlines how we collect, use, protect, and share Personal Identifiable Information (PII) and respects the personal space and independence of residents within our non-medical, independent living residences.

This policy applies to all residents, staff, contractors, and visitors regarding the handling of resident information and interaction within the residence.

2. Information We Collect

We collect information strictly necessary for the operation of the residence, resident intake, safety, and billing. This may include:

  • Personal Identifiable Information (PII): Name, address, date of birth, contact information (phone, email), and emergency contacts.

  • Financial Information: Documentation used for income verification (during screening) and payment history for the monthly Program Fee.

  • Limited Health/Emergency Information: Information regarding allergies, critical medical conditions (for emergency responders only), and designated third-party caregivers/case managers. We do not collect or maintain comprehensive medical records.

 

3. Resident Rights to Privacy and Independence

We uphold the following rights for every resident, essential for their comfort and emotional well-being:

A. Private Space and Belongings

  • Personal Property: Residents have the absolute right to keep and maintain personal possessions within their assigned living space. Management will not intrude upon or inspect a resident’s personal belongings without explicit consent or immediate safety concerns (e.g., suspicion of fire hazard).

  • Room Access: Management staff will only enter a resident's private space for pre-scheduled maintenance, cleaning (if included), emergency situations, or after providing reasonable notice (typically 24 hours) for inspections.

B. Confidential Communication

  • Visits: Residents have the right to receive private visits from family, friends, and personal care providers at any reasonable hour, in accordance with the common-area House Rules (e.g., quiet hours for overnight guests).

  • Confidential Calls and Mail: Residents have the right to make and receive confidential telephone calls and communicate through mail and electronic messages without intrusion, monitoring, or interruption by Provider staff.

C. Autonomy and Choice

  • Independence: This policy emphasizes the importance of privacy and independence, allowing residents to make choices that affect their daily lives, schedules, and social interactions, as long as those choices do not infringe upon the rights or safety of other residents.

 

4. Use and Sharing of Information

A. Internal Use

Resident PII and financial information are used solely for:

  • Billing and collection of the Program Fee.

  • Property management, maintenance coordination, and rule enforcement.

  • Contacting emergency contacts or designated case managers in case of an emergency or termination of the agreement.

B. Disclosure to Third Parties

The Provider will not share or sell any resident information to external parties except under the following conditions:

  • With Written Consent: When the Resident provides explicit, written authorization for the release of specific information (e.g., sharing contact information with an external Home Health agency).

  • By Legal Requirement: When required by subpoena, court order, or governmental agencies (e.g., law enforcement).

  • For Emergency Services: Sharing critical health or emergency contact information with 911 responders or paramedics when the resident is incapacitated.

 

5. Data Security and Protection

We implement reasonable physical, technical, and administrative safeguards to protect resident information from unauthorized access, loss, or disclosure.

  • Physical Records: Limited paper records containing PII are stored in a locked facility or cabinet.

  • Electronic Records: Electronic PII is stored on password-protected systems with restricted access limited to authorized Management personnel.

 

6. HIPAA Principles (Non-Medical Context)

While Peach State Developments LLC is a non-medical facility and typically not classified as a "Covered Entity" under the Health Insurance Portability and Accountability Act (HIPAA), we adhere to the principles of safeguarding the limited health information we may possess:

  • Minimal Necessary Rule: We limit the use and disclosure of any self-reported health information (PHI) to the minimum necessary required for safety and emergency contact.

  • Consent for Sharing PHI: Any disclosure of a resident's health or medical status to a third party (other than emergency services) will only occur with the resident's prior, specific, and voluntary consent.

  • Secure Handling: Any physical or electronic records containing health data will be handled securely and securely destroyed upon resident departure, where legally permissible.

 

7. Social Interaction and Community Building

We encourage a positive living environment that facilitates social interaction and community building. Trained staff understands the importance of personal space and will respect individual privacy preferences regarding participation in group activities. No resident is obligated to participate in any social activity.
